Please carefully read and understand the following terms and conditions before booking a whale watching tour with us. By booking a tour, you agree to adhere to these terms and conditions. We reserve the right to update or modify these terms and conditions at any time by posting updated terms on this website. Any changes will become effective upon publication. It is the passenger’s responsibility to review these terms before booking. 1. Conditions of Entry: • Passengers are expected to behave responsibly and respectfully during the whale watching tour. If you fail to comply, we may cancel or suspend your booking and/or remove you from the premises. • We reserve the right to refuse service to those who are believed to be affected by alcohol or drugs and no refund will be provided. 2. Bookings and Reservations: • Bookings can be made through our website, over the phone, or in person at our physical office at Circular Quay. All bookings are subject to availability. • We require a valid contact number and email address for booking confirmation and updates. • To confirm your booking, you must provide a valid credit card including holder’s name, credit card number, expiry date, and CVC. We accept Visa and Mastercard. Cash payment is accepted, nonetheless, a credit card is still required to confirm your booking. 3. Cancellation and Refund Policy: • Cancellations made more than 7 days before the scheduled departure date may be eligible for a full refund. Any cancellations made after this time will not be eligible for a refund. • Passengers must arrive 30 minutes prior to booking time. Sydney Harbour Attractions reserves the right to resell the seats after this time and charge the client in full if these seats cannot be resold. • Pay on board payments are accepted, however, credit card details are still required to confirm the booking. Please contact us to notify any changes or cancellations. If passengers are unable to arrive and fail to notify us, we may charge the provided credit card for the full booking amount. • We reserve the right to cancel or void your booking if you do not show up or arrive late. This also applies for same day bookings (i.e. those made on the same day as departure). No-shows will not receive a refund. Rescheduling is possible but subject to availability and will be charged a rescheduling fee of $25 per person. 4. Weather and Safety: • The safety of passengers and crew is our top priority. Sydney Harbour Attractions reserves the right to substitute any vessel at any time. Trips may be rescheduled or cancelled due to adverse weather conditions or other safety concerns. • We will operate if it is raining. We reserve the right to cancel services due to inclement weather (generally defined as precipitation greater than a drizzle, wind, and swell conditions). In such cases, we will attempt to reschedule the ride at no cost, or a compensatory voucher will be supplied. • You may experience seasickness during this cruise. If you are prone to seasickness, you make take some of the following precautions: – Eat sensibly. Avoid big breakfasts/lunches as well as rich and fatty foods. Please ensure to still eat something, as being hungry can also lead to nausea. – Check the weather. Seasickness may depend on or be aggravated by the conditions of the sea. It is strongly recommended that you check the weather as calmer sea conditions make you less prone to seasickness and offer a more enjoyable cruise. – Focus on a fixed point. Focusing on a point on shore or the horizon helps your balance as your brain and inner ear resynchronise with one another. – Visit your doctor or local pharmacist. Ask them about travel sickness remedies and tablets you can take prior to your cruise. 5. Delays and Schedule Changes: • We will make every effort to adhere to the agreed upon departure and arrival times. However, circumstances or unforeseen delays may impact the schedule. • We are not responsible for any inconvenience or expenses incurred due to delays or schedule changes. 6. Whale Sighting Guarantee and Rebookings: • We will make every effort to spot whales on every cruise. However, in the highly unlikely event that they are not spotted, we offer whale sighing guarantee. This allows you to rebook for a complimentary whale watching cruise during whale season that falls within 12 months of your original booking. • Please note, these complimentary vouchers are non-transferable and cannot be used in exchange for a refund. 7. Liability: • We carry appropriate insurance for passenger liability and conform to all applicable laws and regulations. • We are not liable for personal injury, illness, or accidents that may occur during the whale watching tour. • Passengers are responsible for their personal belongings. We are not liable for equipment loss or damage to personal property / valuables during the journey. 8. Privacy: • We may collect and store passenger information for booking and communication purposes. We will not share this information with third parties without consent. • By booking a tour with us, you acknowledge that you have read, understood, and agreed to these terms and conditions.
